What do I do about a paid tax lien from 10 years ago that is still appearing on my credit reports?

This was paid in 96. In fact, it was paid so long ago that the state cannot find a record of when it was actually paid. They just know that I don't owe them any money and haven't owed them in quite some time. I was not aware that I had to pay a $34 processing fee to have the lien released until last Sept. I paid it on the 15th and now I have two tax liens on my credit report. One that says that it is unpaid and another that reads "released". Both read that they will stay on my credit report til 2013. I have sent letters to all three credit agencies protesting these blemishes and explaining that the error is due to a processing fee that, like I said before, I was unaware that I had to pay. Is there anything else I can do?

There is nothing complicated at all about this question. Two minutes of simple research is all it took.





The Fair Credit Reporting Act states that credit reporting agencies may report:





"...(3) Paid tax liens which, from date of payment, antedate the report by more than seven years."





In your case, they must report that the lien has been paid off, but the fact that it was placed will remain on your credit for 7 years.





Send a dispute letter to the credit reporting agency, along with any notorized evidence the county (or state) agency who records it stating it has been paid.

If they're having troubles finding a record when it was actually paid, they'll probably have problems finding the original document.

Here is what has happened....the $34 processing fee you paid updated the credit record to show that the lien was reported when you paid the $34...thus starting the 7 year clock again.





I would submit a dispute letter to each of the bureaus and see if tht gets it removed. Considering the information can't be found they may have to just remove it but if that doesn't work I would get an attorney involved.
