Do I have to pay it back if the overpaynent came agout through no fault of mine-they have not disputed the incomes I provided them with. And if I do have to pay back I cannot afford too much,do I get time to do so?

Regardless of who's fault the overpayment was you will have to pay it back. There was a lot of fuss a couple of years back about this sort of thing, with some people going as far to say that this was not legal, but i don't think you'll find any way around it. As for repaying it, you should be able to organise a repayment plan that suits you.
Reply:You will have to pay it back unless you manage to successfuly dispute the overpayment. Phone the helpline on 08453003900 and ask themf or the reason for the overpayment. If the explanation they give you implies the overpayment was their fault then ask for a dispute form and they will send that to you. If you fill out the form and send it back to them they will look into the overpayment and decide if it's justified to ask you to pay the money back. If you aren't successful in the dispute then you will need to pay the money back and can do so at an affordable rate which suits you.
Reply:this happened to me and hubby we have to pay it back at a rate of £5 a month until 2014

nightmare hun hope you get something sorted maybe go welfare rights they can and have helped people in the same situation they tried to help us with ours but every case of overpayment is different so don't give in just yet!

oh and you only have a certain amount of time to dispute so if you going to, ring W/R asap for an appointment

good luck to you and wife x
Reply:This is one of the advantage of living in a democracy,as the government can screw you legally and you can not do anything about it, as it is the law of the land, but you try to claim anything that you are en tiled to and they make it as difficult as possible until you give up claiming.
